Financial crimes 

  • The Bribery Act of 2016
    • Provides a definition of a whistleblower and the protection of whistleblowers and witnesses, from harassment and intimidation, and proposes for the punishment of individuals who retaliate against whistleblowers. 
  • Anti-Corruption And Economic Crimes Act, No. 3 Of 2003
    • Provides for the protection of informers and those who run anonymous websites for reporting of fraud and corruption.

  • In 2021, the Attorney General in consultation with the Ethics and Anti-Corruption Commission (EACC) published Guidelines in respect to the Bribery Act, 

Law proposals:

Kenya has published a draft bill outlining protections for whistleblowers (The Whistleblower Protection Bill, 2024).

  • In November 2024, the UNODC held a workshop in Kenya to support the drafting process of the final version of the draft whistleblower law.
